Definitions

Services means NDIS funded supports and services and or private fee for services that may be offered on this website.

We / Us means Katana Ink’ Services Pty Ltd and any subsidiaries, affiliates, employees, independent contractors, officers, agents or assigns.

The Privacy Act means the Privacy Act 1988 (Cth)

APP means Australian Privacy Principles

NDIA means National Disability Insurance Agency

NDIS means National Disability Insurance Scheme

NDIS Commission means NDIS Quality and Safeguard Commission

OAIC means Office of the Australian Information Commission 

Overview

This policy ensures we protect and handle personal information in accordance with the NDIS and relevant privacy legislation. We acknowledge an individual’s right to privacy while recognising that personal information is required to be collected, maintained and administered in order to provide a safe working environment and a high standard of quality.

The information we collect is used to assess and provide services to people in a safe and healthy environment with individual requirements, to meet duty of care obligations, to initiate appropriate referrals, and to conduct business activities to support those services.

Katana Ink’ Services collects personal information including but not limited to such information as name, date of birth, contact details, health related information, demographics, copies of identification, banking details, information used to verify your identity and personal information to better understand your needs in the area of supports and services. Use of information you have provided us with, or that we have collected and retained relating to your use of the Website and/or our Services, is governed by our Privacy Policy.

We are a service provider and may collect information about people seeking supports and services and baseline information pertaining to workers as part of employment engagement and probity requirements. We will collect, use or disclose information about you only as allowed by law i.e. we have your consent to do so, or we are required by law.

By using this Website and the Services associated with this Website, you are agreeing to the Privacy Policy. By providing personal information to us, you consent to our collection, use and disclosure of that personal information on the terms of this Privacy Policy and any other contractual or other arrangements that apply between us (if any).

Collection of your personal information

 

We have a policy of only collecting the information we need for the task which we need to do for your service provision.

We primarily collect personal information about you is when you give it to us. Your other health care providers may also share personal information with us.

During provision of services to you, we are required to collect a range of personal information from you, including but not limited to name, age, address, date of birth, copies of identification documentation; payment information and banking details; personal information contained in forms or applications; personal information contained in queries, or feedback about our services, health information, health, racial or ethnic origin, political opinions, association memberships, religious beliefs, sexual orientation, criminal history, genetic or biometric information.

Changes to your personal information 

Under the Privacy Act you have the right to ask for access to personal information that we hold about you, and you can ask that we correct that personal information if is in accurate. You can ask for access or correction by contacting us and we must respond within 30 days. We will ask you to confirm your identity before we provide you with a copy of the personal information held by us. If your personal information held by us is voluminous then we may charge a reasonable not excessive fee for retrieval of and provision of that personal information to you. If you ask, we must give you access to your personal information, and take reasonable steps to correct it if we consider it is incorrect, unless there is a law that allows or requires us not to. Disclosure 

Disclosure of sensitive information

We only disclose your sensitive information for the purposes for which you gave it to us or for a purpose which you would reasonably expect or if you agree to disclosure of that information.

There may be times when it is beneficial for Katana Ink’ Services to speak to other people or agencies relevant to you. This will only happen if you provide consent. You change your mind at any time you can withdraw your consent by speaking with your case worker or contacting Katana Ink’ Services by phone or email.

We may also disclose your personal information to:

– Other people / organisations if requested by you and authorised by you

– Other service providers / specialists / carers to support the planning process for supports and services

– Business relation functions in providing us with technology solutions, printing, mailing, data storage, service processing, auditing, legal and or business consulting

There may be individuals for the purposes of this Privacy Policy and the collection, use and disclosure of personal information to whom your personal information may be disclosed to:

– a parent, guardian, carer or other person responsible for your care;

– a person appointed to act for you under a Power of Attorney or Enduring Guardian appointment;

– a person nominated in writing by you.

Katana Ink’ Services may be required by law to provide relevant information about you to the NDIS Commission, National Disability Insurance Agency (NDIA) and or if compelled to do so by law (i.e. court order).

When making a disclosure, we will take reasonable steps necessary to ensure that the recipient is bound by the relevant privacy obligations. Without your consent we will not disclose your personal information to third parties unless required by law, NDIS Commission or NDIA.

Disclosure Overseas 

Our service providers are based in Australia and it is unlikely that your personal information would be disclosed to overseas recipients.

Our website utilises Google Analytics and Google stores information overseas.

Our Commitment to You

To support the privacy and confidentiality of individuals:

– we are committed to complying with the privacy requirements of the Privacy Act, the Australian Privacy Principles and for Privacy Amendment (Notifiable Data Breaches) as required by organisations providing disability services

– we are fully committed to complying with the consent requirements of the NDIS Quality and Safeguarding Framework and relevant state or territory requirements

– we provide all individuals with access to information about the privacy of their personal information

– each individual has the right to opt out of consenting to and providing their personal details if they wish

– individuals have the right to request access to their personal records by requesting this with their contact person

– where we are required to report to government funding bodies, information provided is non-identifiable and related to services and support hours provided, age, disability, language, and nationality

– personal information will only be used by us and will not be shared outside the organisation without your permission unless required by law (e.g. reporting assault, abuse, neglect, or where a court order is issued)

– images or video footage of people will not be used without their consent

– people have the option of being involved in external NDIS audits if they wish.

 

Security of Information

To keep your personal  information secure:

– we take reasonable steps to protect the personal information we hold against misuse, interference, loss, unauthorised access, modification and disclosure

– access to personal information is based on what is required for each independent contractor, person receiving supports and services, volunteer, or student

– we ensure personal information is accessible to the person receiving supports and services and is able for use only by relevant independent contractors

– we ensure security for personal information includes password protection for IT systems, locked filing cabinets and physical access restrictions with only authorised personnel permitted access

– we ensure personal information no longer required is securely destroyed or de-identified.

Data breaches

A data breach is an incident where personal information held by Katana Ink’ Services is lost or subjected to unauthorised access, or unauthorised disclosure.

If we know or suspect your personal information has been accessed by unauthorised parties, and we think this could cause you harm, we will take reasonable steps to reduce the chance of harm and advise you of the breach, and if necessary we will advise the Office of the Australian Information Commissioner.

Complaints

If you wish to make a complaint about how we have handled your personal information, please use the contact details below. We will respond promptly to confirm that we have received your complaint and deal with your complaint within 30 days. If we are not able to resolve your complaint, you may wish to contact the Office of the Australian Information Commissioner at the details set out below; this service will be able to provide you with information about your other options.
